1. Introduction

Best Café Enterprises, LLC dba Corner Bakery (“Corner Bakery,” “we,” “us,” or “our”) cares about your privacy and is committed to protecting the privacy and personal information of guests visiting www.cornerbakerycafe.com, the Corner Bakery Cafe® App, and/or any of our other authorized websites which link to this Privacy Policy (collectively, the “Sites”).

This Privacy Policy (“Policy”) describes the types of information we may collect from you or about you when you visit our Sites, join our Rewards Program (as defined in the Terms and Conditions), or otherwise engage with us (collectively, the “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing your personal information.

This Privacy Policy applies to information we collect:

  • Through our Rewards Program;
  • Through your direct interactions with our Services and other communications with us;
  • When you apply for a job or complete a franchise application; and
  • When you interact with our advertisements and applications on third-party websites and services, if those applications or advertisements include links to this Policy.

This Privacy Policy does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or through our Sites.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will handle it. If you do not agree with our policies and practices, please do not use our Services. By accessing or using our Services, you agree to this Privacy Policy. This Policy may change from time to time (see “Changes to Our Privacy Policy” below). Your continued use of our Services after we make changes to this Privacy Policy is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Sensitive Information Disclosure: As noted above, we collect the following categories of sensitive information from job applicants and franchisee applicants: Social Security Number or tax identification number, and citizenship or immigration status. This information is collected to comply with laws, manage our business, or provide you with our Services.

3. How We May Collect Information

The information Corner Bakery collects falls into three different categories: (1) information you give us; (2) information we collect from you automatically; and (3) information we collect from other sources.

i. Information Collected from You

Some information we collect is provided when you use our Services. You may be required to disclose information to register for an account or transact business on the Sites or otherwise interact with the Services. You may also be asked to provide such information when submitting a franchisee application, job application, survey, or feedback form. By submitting your information, you authorize Corner Bakery to use that information to provide the interaction or Service you have initiated.

ii. Information Collected Automatically

We may use automated means such as web tools (e.g., cookies, pixels, web beacons). Please see “Your Choices” and “Your Rights” below for how to limit data collection through browser settings or manage preferences on our Sites. We, or our service providers, vendors, and other companies and organizations we partner with, may deploy digital tools and/or tracking technologies for various purposes, such as for fraud prevention and to advance our advertising and marketing campaigns. We may also collect information about you from additional online and offline sources including from your social media activities, partner organizations, commercially available third-party sources, your transactions in our stores or on our Sites, any rewards or promotions associated with a purchase, and other publicly available sources. To provide you with more information about your local café, we may also collect the geolocation of your device by, for example, using satellite, cell phone tower, WiFi signals, beacons, Bluetooth, and/or near field communication protocols. We may combine this information with the personal and other information we have collected about you.

Depending on which Site this Policy is posted, we may use Google Analytics to provide certain analytics services for us. More information about Google Analytics can be found in the Google Analytics Terms of Use and the Google Analytics Privacy Policy.

iii. Information Collected from Third Parties

We may also collect information from other companies and organizations, including from service providers and our other vendors. For example, Corner Bakery collects information after you submit an order through a partner website or third-party food delivery service. By gathering additional information about you, we can correct inaccurate information, enhance the security of your transactions, and give you product recommendations and special offers that are more likely to interest you.

4. How We May Use Information

Corner Bakery, our franchisees, or our service providers and/or other vendors may use your information in a variety of ways, including, but not limited to:

  • To process your purchases or requests for products or services, including catering and delivery orders and requests.
  • To communicate with you about your use of the Sites, orders, purchases, returns, services, accounts, programs, contests, and sweepstakes.
  • To respond to your inquiries and for other customer service purposes.
  • To advise you about any of our Services or of changes or additions to the Services.
  • To better understand how users access and use our Services, including to improve the Sites and respond to user preferences, and for other research and analytical purposes to improve our Services or develop new Services.
  • To help maintain the safety, security, and integrity of our Services, products, databases and other technology assets, and business.
  • To manage the “Careers” page of the Sites, which is a tool utilized by Corner Bakery, and by independently owned and operated franchised locations, to assist in their recruiting efforts.
  • To tailor the content and information that Corner Bakery and our franchisees may send or display to you, to offer location customization and personalized help and instructions, and to otherwise personalize your experiences while using the Sites.
  • To assist in advertising Corner Bakery’s products and services on third-party websites and directly to you.
  • To maintain appropriate records for internal administrative purposes.
  • To protect the rights and interests of Corner Bakery and/or our franchisees, such as to resolve any disputes, to enforce this Policy, the Terms, or any other policy, to protect the rights or property of another, to prevent harm, or to respond to legal process (such as a summons in a lawsuit or subpoena).
  • To evaluate or conduct a merger, sale, or other acquisition of some or all of Corner Bakery’s organization or its assets, in which the information held by Corner Bakery about our users of our Services is among the assets transferred.

We may also collect, use, and share publicly available and/or de-identified data for any purpose. De-identified data could be derived from your personal information but is not considered personal information as this data will not directly or indirectly reveal your identity.

5. How We May Share Information

We may share your information with the following categories of third parties:

  • Any member of our corporate group, which includes our subsidiaries, affiliates, our ultimate holding company and its subsidiaries and affiliates.
  • Our franchisees.
  • Our contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Corner Bakery may share your information for the following purposes:

  • Affiliates: We may share information between and among Corner Bakery, our franchisees, and affiliated companies for purposes of management and analysis, decision-making, and other business purposes. For example, we may share your information with our franchisees and affiliated companies to administer our Rewards Program, process orders and requests, and expand and promote our product and service offerings.
  • Third-Party Service Providers: We may disclose your information to third parties who provide services to Corner Bakery or have a contractual relationship with Corner Bakery. These third parties may provide a variety of support services to Corner Bakery, including, but not limited to, administering the Sites or any of the Services we offer, payment processing, email and postal marketing, e-commerce fulfillment, and marketing surveys. These third-party services may include enhancing the information Corner Bakery collects about guests to provide us with analytics services or conduct research.
  • Business Transactions: If Corner Bakery goes through a business transition, such as a merger, an acquisition by another company, or a sale of all or a portion of its assets, in which information collected by Corner Bakery is part of the assets to be transferred.
  • Enforce Our Agreements: Corner Bakery and/or our franchisees may disclose your information to enforce our Terms and Conditions, this Privacy Policy, or any other applicable policies or agreements with you.
  • Legal Purposes: Corner Bakery and/or our franchisees will disclose your information when required by law or under the good-faith belief that such action is necessary under applicable law. Corner Bakery and/or our franchisees may disclose your information to establish or exercise its or their legal rights or defend against legal claims. Corner Bakery and/or our franchisees may also share information to investigate, prevent, or take action regarding illegal activities, suspected fraud, to protect Corner Bakery and/or our franchisees’ property or interests or that of their agents and employees, and to protect guests’ personal safety and/or the public.

As noted previously, we may share non-personal information, including publicly available or de-identified information, without restriction.

6. Online Tracking Technologies

Corner Bakery and/or our third-party service providers utilize different tracking technologies, like cookies, pixels, and web beacons, to enhance browsing and usage experience on the Sites and to enable certain functionalities related to the Sites. Most web browsers can be programmed to accept or reject the use of some or all of these technologies, although you must take additional steps to disable or control other technologies. For more information, please see the section of this Policy titled “Your Choices”.

The information captured about your activities on the Sites makes it possible for us, among other things: (i) to speed navigation and provide you with custom, tailored content; (ii) to remember information you gave to us so you do not have to re-enter it each time you visit the Sites; (iii) to monitor the effectiveness of certain marketing campaigns; (iv) to monitor total number of visitors, pages viewed, the web address from which you came to our Sites, and type of browser you are using; and (v) to enforce limitations on downloads described for online coupons and other similar offers. Below are brief descriptions of the most common types of online tracking technologies.

  • “Cookies” are small files or records that are stored on your computer’s hard drive when you visit a website.
  • “Pixels” or “web beacons” are small, transparent images that are embedded in web pages, applications, and emails that are sometimes called “clear gifs”, “single pixel gifs”, “page tags” or “web bugs”. We use web beacons to track the web pages you visit, to test the effectiveness of our marketing, and to determine if an email has been opened and acted on.
  • “Java scripts” are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components.
  • “Entity Tags” are HTTP code mechanisms that allow portions of websites to be stored or “cached” within your browser and validates these caches when the website is opened, accelerating website performance.
  • “HTML5 local storage” allows data from websites to be stored or “cached” within your browser to store and retrieve data in HTML5 pages when the website is revisited.

7. Text Messaging

By opting into any of our text message programs, you acknowledge and agree that you are expressly consenting to receiving automated mobile text (e.g., SMS and/or MMS or successor protocols or technologies) messages/alerts (collectively, “Text Messages”) that may be sent using automated technology, including through an automatic telephone dialing system or auto dialer. You “opt in” whenever you voluntarily provide us your mobile number via our Services or otherwise for either or both of the following purposes: (i) Transactional: to receive non-marketing communications, including information about an order you have placed or about your membership or account with us; and/or (ii) Marketing: to receive marketing communications, including information regarding promotions, services, offers, advertising, events, other marketing-related activities related to or associated with our products or Services (as well as those of our partners). You further acknowledge and agree:

  • By opting in, you expressly consent to us and our businesses sending you these Text Messages even if your mobile number is registered on any state or federal “Do Not Call” list.
  • You understand and acknowledge that providing consent to receive any of our Text Messages is not a condition of purchasing any goods or services and that your participation is completely voluntary.
  • You are 18 years of age or older and that you are the current subscriber or authorized user of the mobile number you have provided. You agree that you will not use our text message program to initiate messages to the mobile phone of any other person or entity without authorization. If you change, forfeit, or deactivate the phone number you have provided to us, you agree to notify us immediately.
  • Message and data rates may apply for any Text Messages sent to you from us and to us from you. The maximum number of messages per month you will receive will vary based on your activity and/or the text message program in which you have enrolled. If you have any questions about your text or data plan, please contact your wireless provider.
  • OPT-OUT OR STOP: If you wish to stop receiving text messages from us, reply with “STOP” to any text message you receive from us.
  • HELP OR SUPPORT: If at any time you need help, reply with “HELP” to any text message you receive from us. Upon receiving your text message, we will send you a text message with our contact information.
  • SUPPORTED CARRIERS: This program is supported by Alltel, AT&T, Boost, Sprint, Verizon Wireless, Virgin Mobile, MetroPCS, T-Mobile, U.S. Cellular, and various other local and national wireless carriers.

8. Third-Party Websites

Our Sites may offer links to third-party websites that are not operated by Corner Bakery. If you visit one of these linked websites, you should review its privacy policy and any other applicable policies since your access and use of any third-party website is governed by the terms set by the website owner. Corner Bakery cannot and does not accept responsibility for the contents or actions of any third-party websites, and any information you submit to those companies is specifically outside the scope of this Policy.

9. Protecting Your Information

Corner Bakery uses commercially reasonable technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure or modification of your information. Please note that email submissions may not be secure, so do not include any sensitive or confidential information in your message to us.

While we have employed security technologies and procedures to assist safeguarding your information, no system or network can be guaranteed to be 100% secure. Please bear that in mind when deciding what information to disclose to Corner Bakery. If at any time you are asked for information that you do not wish to be disclosed in any of the ways discussed above, you should terminate the transaction or cancel your account registration immediately.

If you choose to register for an account via the Sites, you are solely responsible for maintaining the confidentiality of your account information (i.e., user ID, password and/or challenge questions). Corner Bakery is not liable for any unauthorized disclosure of your information that results from your failure to adequately protect your account information.

10. Interest Based Advertising

Our Services may integrate technology of third-party advertising networks (“Ad Networks”) that allow for the recognition of devices associated with you and the collection of information about the browsing, searching, and other activities of you or anyone else using your devices. This information is then used to send you advertisements for products and services that are more likely to be of interest to you.

To enable interest-based advertising across devices and software, we may also share data, such as technical identifiers derived from your registration information on our Sites, with these Ad Networks. This allows them to link your devices, browser, etc. and to better identify you across different environments.

If you do not wish to participate in interest-based advertising, you may opt-out by visiting and following the instructions set forth at either: (1) the Digital Advertising Alliance’s website (www.aboutads.info); or (2) the Network Advertising Initiative’s website (www.networkadvertising.org/choices). A couple of important notes about these opt-out tools: (i) they include all the advertising networks that we may work with, but also many that we do not work with; and (ii) they may rely on cookies to ensure that a given advertising network does not collect information about you (“Opt-out Cookies”). Therefore, if you use different devices, change web browser, or delete these Opt-out Cookies, you will need to perform the opt-out task again.

11. Your Choices

i. Promotional Communications

You may opt-out of receiving promotional emails and mailings from Corner Bakery at any time by following the unsubscribe instructions provided in the communication. Please note that if you opt-out of receiving promotional communications from us, we may still send you transactional communications, including emails about your accounts or purchases.

Where our Corner Bakery Cafe® mobile application (“App”) allows for the delivery of “push notifications” you can also opt out of receiving these notifications via your device settings. By downloading and using the App, you may receive promotional messages, offers, news and information about Corner Bakery or our business partners within the mobile application. These “in app” messages are part of the App’s functionality and cannot be turned off. If you do not want to receive “in app” messages, offers, news, and information, do not download or use the App

ii. Notice of Financial Incentive and Bona Fide Loyalty Program

From time to time, we may offer coupons or other price reductions for our products and services for enrolling in email updates, newsletter delivery, contests, our Rewards Program (as described in our Terms and Conditions), or similar services we provide (“Incentives”) in exchange for our use of your personal information. To provide these Incentives, we utilize the identifiers you have provided to us and may use the details from your commercial relationship with us (from your commercial information). To opt out of the financial incentives, please follow the applicable steps identified in the “Your Rights” and “Your Choices” sections of this Privacy Policy. If you opt out, we will not reduce the value of any financial incentives you previously received from us. The value of data from our Rewards Program is calculated by determining the approximate additional spending per Participant, per year compared to individuals who have not participated in our Rewards Program. The value of the Rewards Program data is reasonably related to the costs associated with offering the Rewards Program Incentives. We do not assign a monetary value to the other data that we collect and strive to only use that information to further our business in accordance with our Privacy Policy, and to the extent there is any value, it is reasonably related to the applicable Incentives.

iii. Location Information

You may be able to adjust the settings of your device so that information about your physical location is not sent to us or third parties by either (i) disabling location services within the device settings; or (ii) denying certain websites or mobile applications permission to access location information by changing the relevant preferences and permissions in your mobile device or browser settings. Please note that your location may be derived from your WiFi, Bluetooth, and other device settings. See your device settings for more information.

iv. Blocking Cookies

To block cookies used on the Sites, you can clear your browser(s) of all existing cookies and set your browser(s) to refuse cookies. The “help” functionality of your browser(s) will explain how to do this. If you refuse cookies, your experience on the Sites and some of our online advertising may be affected, meaning you may not be able to utilize all of the features on the Sites or Services.

12. Your Rights

Certain state consumer privacy laws provide the residents of those states with rights related to their personal information.

  • Depending upon where you reside you may have:
    • the right to know what personal information we process about you;
    • the right to request certain personal information that we process about you be deleted;
    • the right to have certain personal information we process about you returned to you in an accessible and useable format upon your request, if such request is technically feasible;
    • the right to request we correct personal information we have about you which you believe is incorrect;
    • the right to opt-out of the sale of your personal information; and
    • the right to opt-out of having your personal information processed in such a way that enables us to create a profile on you or for targeted advertising purposes.

INFORMATION ACCESS

If you are a registered user, you may edit your email address and password by logging into your account and making changes to your profile.

We have created mechanisms to provide you with the following control over your information:

  • Marketing. If you do not want us to use your email address or other contact information to promote or recommend our own products and Services, or third parties’ products or services, you can opt-out by replying to any promotional email we have sent you or following the opt-out links on that message. This opt-out generally will not apply to information provided to us following or related to a product purchase, service experience, or other transactions.
  • Accessing, Updating, and Deleting Your Information. If you have an account with us, you may have the ability to access your information and make updates to or delete your data. If not, you can contact us as set forth in the “Contact Us” section below to request access to, correction of, or deletion of personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.
  • Location Information. As noted, when you use the Sites, we may automatically collect certain device specific information. This includes the general or specific location of your device through GPS, Bluetooth, or WiFi signals. In all instances, you may withdraw your consent for us to receive your location-specific information by disabling location features for your device.
  • Cookies and Automatic Data Collection Technologies. Please see above for information on how we use automatic data collection technologies and how you may manage your preferences or opt-out.
  • Interest Based Advertising. Please see above for information on how to opt-out of interest-based advertising.

California Residents. If you are a California resident, you may have additional personal rights and choices regarding your personal data. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our website that are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. We do not engage in this type of disclosure.

How we verify consumer requests

We may require that your identity be verified prior to processing a verifiable rights request. We may verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity we may request additional information from you, consistent with applicable law. We reserve the right to deny a rights request if you are unable to verify your identity.

Authorized Agents

Some states permit you to designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law, we may still require that you verify your own identity directly to us depending on the nature of the request and sensitivity of the information at issue.

If you are an authorized agent submitting a request on behalf of an individual, you must include a copy of the written, signed permission indicating that you are permitted to act on that person’s behalf.

APPEALING A DENIED REQUEST TO EXERCISE STATE PRIVACY RIGHTS

In some circumstances, we may deny your request to exercise one or more of the rights described above. If you disagree with our decision to deny your request or any portion of our request, you have the right to appeal our decision within sixty (60) days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than sixty (60) days after you have been notified of our decision to deny the request we may deny your appeal. If you submit an appeal, we will respond within forty-five (45) days of our receipt of your appeal.

If you wish to appeal a decision, please clearly and plainly describe your basis of disagreement with our decision by responding through the same means by which we communicated our decision or by submitting your appeal using the information provided in the “Contact Us” section below. We will review your appeal and either amend or uphold our decision. In either case, we will provide a written explanation of the reason for the decision. This decision will be final.

13. Children’s Online Privacy

The Sites offered by Corner Bakery are not directed towards children under the age of 18, and Corner Bakery does not request or knowingly collect information from anyone under the age of 18 without parental consent. By using our Sites, you are warranting you are at least 18 years of age. If Corner Bakery becomes aware that a guest of the Sites is under the age of 18 and/or that we have collected the information of a child under the age of 18 through the Sites without parental contest, then we will delete their information. Additionally, you must be 18 years old to register or create an account with us. By creating an account, you represent you are at least 18 years old.

Special Notice for Nevada Residents

Nevada law allows consumers to direct certain businesses not to sell their information to third parties to license or sell that information to additional third parties. If you are a Nevada resident, you may submit such opt-out requests to privacy-nv@cornerbakerycafe.com. To be effective, your request must include your full name, address, phone number, and email address.

14. Changes to our Privacy Policy

We will post any changes we may make to this Policy on our website. The Policy’s effective date is identified at the top of the page. You are responsible for periodically visiting our website and this page to check for any changes.
